Once a ruling in favour of the Guyana Teachers’ Union (GTU) is made, the existing preliminary teachers’ promotion lists that were prepared a few months ago will become “null and void.” This disclosure was yesterday made by GTU President, Mark Lyte.The preliminary promotion lists for public school teachers prepared by the Teaching Service Commission (TSC) and the School Board Secretariat were left in limbo last month,Cheap Adidas NHL Jerseys, following a move by the GTU to file an injunction preventing the two bodies from producing finalized lists.Had the finalized promotion lists been completed, the promotion of teachers would have become effective from the start of the new school year.The new school year is set to commence on August 31, 2015, but since the matter is still gaining the attention of the Court, Lyte yesterday intimated that all teachers named on the preliminary lists will retain their status. His disclosure comes on the heels of vocalized uncertainty by a number of teachers named on the preliminary promotion lists.“Teachers who saw their names on the preliminary lists, they want to know what will  happen to them now that there wasn’t any final list,” said Lyte in commenting on the state of affairs yesterday.He confirmed that because the issue is before the court, it has essentially blocked the publishing of the final promotion lists from both the TSC and the School Board Secretariat ahead of the opening of school this month end.Lyte explained that the decision to file the injunction came as a result of numerous complaints from some teachers across the Union’s 39 branches, who are convinced that the process of promotion, in some instances, was unfair.Concerns in this regard were raised when the Union held its general council meeting on July 7, 2015, at which time it was decided that the course of action would be to file an injunction.“This was a general council decision,” said Lyte, as he expressed hope that the court action will allow for a review of all applications for promotion will be reviewed at the earliest possible time. He is optimistic that a possible review could be completed, allowing for promotions to become effective in time for the January school term.The GTU, through its lawyer Roysdale Forde, filed the motion on July 10 in the High Court, and the injunction was granted by Chief Justice (ag) Ian Chang, who has ordered the TSC and the Minister of Education, respectively, to assess all applications for the 2015 promotions.Both were expected to show cause why the appointments should not be deemed “unlawful, ultra vires,  irrational, unreasonable, wholly in excess of jurisdiction, unreasonable, null, void and of no legal effect when the matter was called on July 31, 2015.The matter was however adjourned to September 18, 2015 and according to Lyte “if they don’t respond the court could go ahead and rule in the Union’s favour.”An official close to the GTU had told this publication that the GTU’s move to halt the release of the list was premised on the TSC’s deviation from written rules and regulations that govern the promotion of teachers in the public education system.According to the official, while the rules clearly outline that teachers should be promoted based on a point system, information suggests that this was not adhered to for the promotion of some teachers.The resulting state of affairs was that although some teachers might have scored the highest possible points, they were refused promotion, because of reports from regional officers or head teachers that they needed more supervision.Moreover, there were reported cases where a teacher with fewer points was instead promoted.“We feel that the process has been breached, so that was one of the issues that was brought up and deliberated on at general council,” said the official, who revealed that the GTU was reportedly apprised of the infraction by its nominee who sits on the TSC.The nominee had reportedly divulged that on several occasions teachers were promoted, even though they were seconded from a school to the Department of Education.“They applied and got promoted over somebody in the school system,” said the official, who pointed out that “the rules clearly state that a person can only be promoted if the term or the period of their secondment has ended.”
