| Toolsie Persaud Limited (TPL) has been the only logging company reluctant to work with the Guyana Forestry Commission and to remedy the situation with its breaches, Minister of Agriculture, Robert Persaud said yesterday. The Minister made the comment at a press conference on various forestry issues within the sector.He told the media that many other companies, which were also found to be committing breaches, have been working with the GFC to remedy the situation and have been paying their compensation.“I have suspended the TSA and have so advised the President, who under the Forest Act, is the Minister of Forestry, to make the final determination on whether the action I have taken will be upheld or whether he rules that I lift the suspension.”According to the Minister, many of the other companies that were found in breach of the Forestry regulations have been working with the Commission to ensure that there is no reoccurrence of these types of breaches.“Many have settled and some are still settling but have not sought recourse in the court or other forms of distraction from the Commission carrying out its legal responsibilities,” Persaud pointed out.Addressing the issue of how the compensation is calculated, Commissioner of Forestry, James Singh said that when companies are caught breaching the regulation for the first time they are required to pay 1/6 of the market value of the produce to the commission.In the second instance, 35 percent of the market value of the produce is paid and in the third instance, the entire product is seized.“It’s a very simple but consistent methodology and it applies to all companies and has been approved by the GFC Board of Directors.”Minister Persaud said that the commission is not “here to hurt the industry. We are not here to make life difficult for the industry…we are here to create a competitive sector but one that is in compliance with the law of the country.”Last week Tuesday, the Minister of Agriculture suspended the TSA for TPL.The letter of suspension was sent to the company’s Managing Director, David Persaud.The GFC and TPL have been at loggerheads since April when the Commission suspended the company’s State Forest Permit.This was done after GFC found breaches in harvesting regulation, and for which the company has since accepted liability. The company is required to pay the Commission $40M but TPL moved to the court preventing the Commission from collecting the sum.According to the GFC, the breaches, for which the company has to pay compensation,Cheap Authentic Dallas Cowboys Jerseys, were discovered during a routine post harvest audit of TPL’s operations in 2007.Based of the findings in 2007, the GFC said, it has since implemented more intensive monitoring programmes, which have already resulted in one large company being found in breach of procedures in February 2008. Following the decision to suspend the TSA for the company, TPL has since admitted that it committed breaches at its Manaka concession and is now at the ‘mercy and judgment’ of President Bharrat Jagdeo.The company is claiming that the calculation of the compensation to the commission was not correctly done but was willing to pay $15M of the $40M.This offer has since been refused by the commission.The company has since requested a meeting with President Jagdeo.
